1. Preamble

1.1. This company (the "Operator", "We", "Us") operates searchRouter, a real-time search engine API service for AI agents and RAG workflows, providing web search and content extraction capabilities (the "Service"). These Terms of Service apply to all users of the Service ("User").

1.2. Users of the Service who use a subscription plan or pay-as-you-go credits also agree to our General Terms and Conditions and Privacy Policy.

2. Rights of Use

2.1. The User may use the Service for both personal and commercial purposes, including integration into AI agents, RAG workflows, and other applications, subject to the limitations set forth in these Terms of Service and any applicable subscription plan.

2.2. The Operator has the right to restrict the use of the Service or block Users for violations of these Terms of Service or for any other reason at its sole discretion.

2.3. By using the Service, the User agrees that the Operator may store the User's IP address, API usage data, and search queries to monitor service usage, improve performance, and prevent abuse.

2.4. Children under the age of 13 (or the minimum legal age required to provide consent for processing of personal data in the country where the child is located) may not access or use the Service.

3. Rights and Obligations of the User

3.1. The User undertakes to refrain from any actions that endanger the functionality or operation of the Service. In particular, the User is prohibited from:

  • Scanning or testing vulnerabilities of the Service
  • Bypassing security systems or accessing unauthorized systems
  • Integrating malware into the Service
  • Attempting to reverse engineer or decompile the Service
  • Making excessive API requests that could impact service performance

3.2. The User guarantees that they will use the search and content extraction capabilities in compliance with applicable laws and the terms of service of third-party websites and content providers.

3.3. The User is responsible for maintaining the confidentiality of their API keys, account credentials, and for all activities that occur under their account.

4. Acceptable Use of the Service

4.1. User agrees not to use the Service in any manner that:

  • Promotes or creates a risk of physical or mental harm, emotional distress, death, disability, or disfigurement
  • Promotes or creates a risk of harm, loss, or damage to any property
  • Seeks to harm or exploit children
  • Is harassing, abusive, racially or ethnically offensive, defamatory, invasive of personal privacy, libelous, or threatening
  • Discriminates against others based on race, religion, sex, sexual orientation, age, disability, ancestry, national origin, or any other protected basis
  • Involves the search for or extraction of sexually explicit or pornographic content
  • Involves the search for or promotion of illegal activities, products, or services
  • Is fraudulent or promotes fraudulent activity
  • Violates the rights of any individual or third party, including intellectual property and privacy rights
  • Attempts to extract false, deceptive, or misleading information
  • Violates any applicable law or promotes illegal activities
  • Threatens or undermines democratic processes or institutions
  • Attempts to scrape or extract content in violation of website terms of service or robots.txt files

4.2. The Operator reserves the right to determine whether usage violates this clause at its sole discretion.

5. Restrictions on Use of the Service

5.1. User shall not use the Service in any way that goes against its intended use as a web search and content extraction API.

5.2. User shall not:

  • Rent, lease, sell, distribute, sublicense, or otherwise make available the Service to any third party without proper authorization
  • Copy, replicate, decompile, reverse-engineer, or create derivative works of the Service
  • Access the Service for performance benchmarking or building competitive search engine products
  • Use the Service to store or transmit viruses or malicious code
  • Use the Service for unauthorized data mining, extraction, or scraping that violates third-party terms of service
  • Bypass any API rate limits, usage limitations, or access restrictions
  • Share API keys or account credentials with unauthorized parties

6. Intellectual Property

6.1. The Service and all related technology, software, algorithms, and API infrastructure are the exclusive property of the Operator and are protected by intellectual property laws.

6.2. Users retain ownership of their search queries and any original content they provide. By using the Service, Users grant the Operator a limited license to process their queries solely for the purpose of providing search and extraction services.

6.3. The search results, extracted content, and data provided by the Service are sourced from third-party websites and content providers. Users acknowledge that such content may be subject to the intellectual property rights of the original content owners.

7. Privacy and Data Protection

7.1. The collection, use, and protection of personal data is governed by our Privacy Policy, which is incorporated into these Terms of Service by reference.

7.2. Users acknowledge that search and content extraction services may involve temporary storage and processing of search queries, API requests, and extracted content on our servers for service delivery and performance optimization.

8. Service Availability and Modifications

8.1. The Operator strives to maintain high service availability but does not guarantee uninterrupted access to the Service.

8.2. The Operator reserves the right to modify, suspend, or discontinue the Service at any time with or without notice.

8.3. These Terms of Service may be updated from time to time. Continued use of the Service after such updates constitutes acceptance of the revised terms.

9. Limitation of Liability

9.1. The Service is provided "as is" without warranties of any kind, either express or implied.

9.2. The Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of the Service.

9.3. The Operator's total liability shall not exceed the amount paid by the User for the Service in the twelve months preceding the claim.

10. Termination

10.1. Either party may terminate the service relationship at any time.

10.2. The Operator may immediately terminate or suspend access to the Service for violations of these Terms of Service.

10.3. Upon termination, all rights and obligations under these Terms of Service shall cease, except for those that by their nature should survive termination.

11. Governing Law and Dispute Resolution

11.1. These Terms of Service shall be governed by and construed in accordance with applicable local laws.

11.2. Any disputes arising from these Terms of Service shall be resolved through appropriate legal channels in the jurisdiction where the Operator is located.
